Commercial Litigation and Court Representation

When settlement is not possible, we try the case in state and federal court.

Some disputes cannot be settled because the other side is not acting in good faith, the money is already gone, or the principle at stake is too important. When that happens, you need lawyers who are comfortable in a courtroom and who prepare every case as if it will be tried. Our litigation team handles matters from complaint through trial, appeal, and collection of the judgment.

Situations we handle

  • Breach of contract and breach of warranty
  • Business fraud, fraudulent inducement, and misrepresentation
  • Breach of fiduciary duty and shareholder or member disputes
  • Emergency injunctions and temporary restraining orders
  • Trade secret, non compete, and unfair competition claims
  • Judgment enforcement, asset discovery, and collection

Our Approach

How we handle commercial litigation

  • 1

    Trial ready from day one

We build the case around what we will need to prove at trial, which also produces the strongest settlement position along the way.

  • 2

    Strategic motion practice

Early motions for injunctions, attachment, or summary judgment can end a case or shift its economics dramatically. We use them deliberately.

  • 3

    Discovery with purpose

Discovery is where most litigation budgets are lost. We target the documents and witnesses that matter and resist fishing expeditions from the other side.

  • 4

    Judgment enforcement

Winning is only half the job. We locate assets, pursue garnishment and liens, and domesticate judgments across state lines so a verdict becomes a recovery.

Common Questions

Commercial Litigation FAQ

How long does a business lawsuit take?

It depends on the court and the complexity, but most commercial cases resolve within 12 to 24 months, and many settle earlier once discovery reveals the strength of the evidence.

What will it cost?

We provide a budget at the outset broken down by phase, and we update it as the case develops. For appropriate matters we offer contingency and hybrid fee structures.

Can you handle a case outside Illinois?

Yes. We appear directly in courts where our attorneys are admitted and work with trusted local counsel elsewhere. Federal court matters can often be handled directly.
